7月31日，该案20名被告人在黄石港区人民法院接受一审宣判，判决书长达117页，20名被告人均被判处实刑，其中18人被以非法采矿罪判刑，另2名明知是非法采砂仍然购买的船主因掩饰、隐瞒犯罪所得罪获刑。

投资1个亿

三艘采砂船长江盗采

2014年下半年，安徽人田某某与人合资1亿元，建造了三艘采砂泵船，船号分别为皖鸿运工688、788、988，船主均为田某某。2015年初，田某某找到阳新人柯某贵，双方商议，将三条采砂船开到富池水域采砂牟利，由采砂船负责采砂作业，并销售江砂、收取砂款。柯某贵则负责派人在船上站泵，也就是上船望风、疏通关系及提供保护，双方按比例分配利润。

从2015年1月至5月期间，皖鸿运工688、788、988号采砂船在未取得采砂许可证的情况下，由田某某统一指挥、柯某贵提供保护，在长江阳新富池等水域进行非法采砂作业。后因长江汛期严管，三条船驶离长江黄石水域。

2015年9月份，皖鸿运工688、988号采砂船在田某某的统一指挥下，再次来到长江黄冈蕲春、黄石西塞山等水域进行非法采砂作业。为避免有关部门查处，二条船采取白天停靠休息、晚上开采的办法偷采江砂。

据统计，2015年1月至10月期间，皖鸿运工688、788、988号三条采砂船在长江阳新富池、西塞山等水域，累计采砂99起，销售总金额达9812817.92元。经鉴定，三条采砂船共造成矿产资源破坏价值数额达16741038元。

特警出动

现场抓获43人

三艘采砂船盗采的行为，早已引起长航公安黄石分局的注意。

原来，自2015年2月以来，长江黄石段水域就出现不少采砂船，对江底砂石进行非法开采。这种开采行为对通航秩序、堤防安全、水上治安和长江生态等，都存在巨大危害。

发现这一情况后，长航公安黄石分局联合黄石市公安局，成立“9.17”非法采矿案专班，对此展开了秘密调查。调查过程中，专班民警发现，这是一伙有组织的非法开采江砂团伙，采砂船大多来自江西、安徽等地，主要集中在鄂州燕矶、三江口、杨叶戴家洲，黄冈浠水兰溪与散花、蕲春蕲州、武穴，黄石西塞、黄颡口、富池等地，大肆盗采江砂。

高峰时期，仅在长江黄石水域，就有大型吸砂泵11艘，小型吸砂船百余艘。

“那时候只要晚上一开始打砂，我站在堤坝上都感到脚下在震动。”曾住在西塞山下的村民刘师傅说，他夜晚经过江堤回家时，听见江中央传来较大噪音，感觉整个大堤都在颤动。

2015年10月20日晚，民警侦查发现，“皖鸿运工688号”和“皖鸿运工988号”两艘采砂船进入西塞山水域，正在盗采江砂，还有两艘运砂货船正在购买非法开采的江砂。

长航公安黄石分局立即调集民用货船，装载着黄石市公安局特警支队50名持枪特警，悄悄靠近采砂船，化妆要装载江砂。当货船靠上采砂船后，特警立即冲入采砂船上，将2艘正在采砂作业的大型采砂船和2艘运砂货船查扣，现场抓获犯罪嫌疑人田某某等43人，收缴刀、斧、梭8件。

暴利下的偷采

一晚可获利200余万

这些人敢肆无忌惮地采砂，全仗着“站泵”人的保护。

提供“站泵”的人，多是当地闲杂人员，为了掌握相关部门可能采取的打击行动，他们甚至安排专人，来到长航公安、水政等部门趸船、快艇停放处放哨。一旦相关部门出动人员或船艇，放哨人员立马通知采砂船停止采砂，驶离现场。

“带泵、站泵人员说白了就是看场子、放哨人员。”民警介绍，他们一方面控制采砂水域，不准其他采砂船来采，另一方面对相关监管部门进行望风，防止监管部门查处。

“2015年，从黄石江面上非法盗采的江砂价格是每吨11元至13元。”民警介绍，一条货船可装七八千吨，有的甚至可以装1万多吨，采砂船每装满一条船，就可获得少则70多万元、多则100多万元的砂款。

每笔砂款中，除去号头费、油费、小费等费用开支后，剩下就是采砂的纯利润。“这些采砂船盗采国家资源，为自己牟取了暴利，一艘采砂船一晚便可获得纯利润207万余元。”民警表示，这些利润按四六分成，而像柯某贵这种负责站泵的一方，可分得六成，采砂船一方分得四成。

案发后，负责安排“站泵”的柯某贵、邹某等人也陆续被公安机关抓获。包括柯某贵、田某某等人在内的20人，因涉嫌犯罪被提起公诉。

法律的严惩

20人被判刑

7月31日，此案历时近一年的审理，迎来一审宣判。

黄石港区人民法院审理认为，柯某贵、田某某等18人违反矿产资源法的规定，在未取得采矿许可证的情况下擅自采矿，其行为均已构成非法采矿罪。

而货船船主汤某、邓某为了暴利，明知是犯罪所得而予以收购，二人的行为均已构成掩饰、隐瞒犯罪所得罪。

最终宣判，柯某贵获刑最重，被判处有期徒刑四年六个月，并处罚金4万元；田某某获刑四年三个月，处罚金4万元；其余16人分别被判处一年八个月至四年不等刑期。汤某与邓某则分别被判处十个月和九个月的有期徒刑，并处罚金2万元。

法院还判决，对违法所得9812817.92元应予追缴，上缴国库；对犯罪工具田某某名下的皖鸿运工688号、988号采砂船依法予以没收；两艘货船上已扣押的黄砂5849.88吨和7713.28吨依法予以没收。

非法采砂危害大

干扰航道威胁堤防

长航公安黄石分局刑侦支队民警介绍，非法盗采江砂，对长江水域的危害巨大。

首先，这种行为破坏了水域航行秩序。由于大批非法采砂船聚集，随意开采，有的甚至占据主航道任意穿行，造成正常船舶航行困难，大型船队滞航；有的则在大桥水域、锚地夜间偷采，危及过桥及进出锚地船舶安全，极易造成水上交通事故发生。

其次，非法采砂也对长江堤防带来了安全隐患。非法采砂会引起长江河势的变迁，往往采砂过后，江底留下十几米至几十米以上的深坑，容易导致长江大堤崩岸，危及大堤的防洪安全。同时，还会对长江水域生态系统产生破坏，如对局部鱼类产卵栖息觅食等甚至会产生毁灭性影响。

另外，非法采砂也恶化了水上治安形势。由于暴利驱使，一些人冒险无证驾驶船舶盗采，有些采砂业主寻求恶势力保护，暴力抗法。有些地方的社会恶势力也介入砂石经营，坐收渔利，进行敲诈勒索、抢劫、寻衅滋事违法罪活动，影响了长江治安形势。

重拳下的治理

江面恢复平静

8月2日下午，在黄石港区海事处的帮助下，东楚晚报记者登上了海巡艇，来到西塞山下游采砂船曾经非法开采的长江水域，如今这里已经恢复平静，船只往来畅通无阻。

“以前可不是这样，以前长江中水期时，这里会有采砂船非法采砂，常常碍航或占据航道。”海事执法人员胡学东介绍，采砂船往往跟着江底的砂石走，哪里砂石多，它就去哪里，进入航道也就是常有的事情了。

采砂船一进入航道，往往就会占据三分之一的航道，那就会严重阻碍正常航行的船只通行，海事执法人员发现后，就会出艇去驱赶。“可是你赶他就走，等你走了，他又来了。”海事人员介绍，他们对采砂没有行政监管权，只能在其碍航时进行驱赶，有时候一晚上要驱赶采砂船二三次。

同时，采砂船非法采砂一般都是在晚上，因为这样可以逃避相关部门的监管和打击。可是，采砂船上的灯光很容易挡住江面上的航标灯，让正常航行的船舶看不清或看不见航标灯，对上下水船舶形成安全隐患。

“如今，经过长航公安等部门的打击后，黄石江面再无一艘非法采砂船，船舶航行也畅通了许多。”胡学东说。
